Court News: Center for Human Rights and Others V. The United Republic of Tanzania

On 5th February, 2025 the African Court on Human and peoples’ rights delivered a landmark judgement, the court delivered a decision in the case of center for Human rights and Others V. the United Republic of Tanzania.

In his decision, the court held that the government of Tanzania had violated the rights of people with Albinism, Amongst the key findings of the court:

1.The right to life was violated

2. The right to dignity under article 05 of the charter and freedom from torture, and non-degrading treatment protected under article 02 of the African charter.

The right to education, and the right no to be subjected to abduction, and the prohibition of sale and human trafficking under article 05 of the children’s charter.

Further, in his judgement the court acknowledged challenges faced by persons with albinism and called upon Tanzania to take concrete steps; including:

  • Establishing a victim’s compensation fund
  • Strengthening legal protections against violence and discrimination of persons with albinism
  • Amend the witchcraft Act of 1928 in order to clarify the ambiguities in relation to witchcraft and traditional health practices
  • Implementing a national action plan and awareness campaigns
  • Enhancing access to education, healthcare and child protection services.
  • Addressing concerns related to trafficking, abduction and the sale of persons with albinism children
  • Finally, to initiate the guarantees of non-repetition

This landmark judgement sets an important legal precedent on which to base enforcement and protection of the rights of persons with albinism in the African continent and across the world.
